Welcome to Turnkey Telehealth. Please read these Terms of Service ("Terms") carefully as they govern your access to and use of our services.

2. Eligibility


Our services are intended solely for licensed medical professionals. By accessing and using our services, you represent and warrant that you are a licensed medical professional and have all necessary rights, powers, and authority to enter into these Terms.


3. Services


We offer comprehensive consulting services tailored for both medical professionals and organizations. Our suite of services encompasses a wide range of expertise, including Electronic Health Record (EHR) guidance, implementation of best practices, telehealth training, web design, marketing strategies, and regular updates on industry trends and advancements.


In addition, we extend our support to individual patients, providing assistance in various capacities. This includes facilitating connections with healthcare providers for telehealth visits and empowering patients with access to valuable resources to enhance their overall health and well-being.

 

4. Limitations


Our services are advisory in nature. You are solely responsible for any decisions or actions taken based on our advice or information. We are not liable for any outcomes resulting from the application of our recommendations.


5. Payment


Fees for our services will be communicated prior to engagement. Payments are due as specified in the respective invoice or agreement.


6. Confidentiality


Both parties agree to maintain the confidentiality of all information obtained during the consultancy. Neither party shall disclose, reproduce, or distribute such information without the written consent of the other.


7. Termination


Either party may terminate the consultancy agreement at any time with 30 days written notice. Outstanding payments for services rendered until the termination date will remain due and all payments are non-refundable.


8. Disclaimers


Our services are provided "as is" without any guarantees or warranties of any kind, either express or implied. We do not guarantee any specific results from our consultancy.


9. Limitation of Liability


In no event will Turnkey Telehealth be liable for any indirect, special, consequential, or punitive damages, whether in an action under contract, tort, or any other theory, arising out of or in connection with our services, even if advised of the possibility of such damages.


10. Indemnification


You agree to indemnify and hold Turnkey Telehealth, our partners, directors, officers, employees and our subsidiaries, harmless from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or relating to your misuse of our services or violation of these Terms.


11. Governing Law and Jurisdiction


These Terms shall be governed by and construed in accordance with the laws of New York. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New York.


12. Changes to Terms


We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on our website. Your continued use of our services after such changes constitutes your acceptance of the updated Terms.

You understand that you have the right to refuse or withdraw consent at any time, and that doing so may affect the availability or quality of services provided. We will respect your decisions regarding your healthcare and privacy to the extent permitted by law.

Patients understand that failure to make timely payments may result in additional fees, suspension of services, or other consequences as determined by their healthcare provider or organization.


17. Patient Responsibility


Patients are responsible for:


a. Providing accurate and complete information about their medical history, current health status, and any other relevant information necessary for the provision of healthcare services.
b. Following the instructions and recommendations provided by their healthcare provider or organization regarding their care and treatment.
c. Notifying their healthcare provider or organization of any changes in their health status or other relevant circumstances that may affect their care.
d. Complying with any applicable laws, regulations, or policies related to their use of healthcare services, including those pertaining to patient privacy and confidentiality.


Patients understand that their failure to fulfill these responsibilities may impact the quality of care they receive and may result in limitations or restrictions on their access to services.


18. Release of Information Policy


Patients acknowledge that their personal health information may be collected, used, and disclosed in accordance with our Privacy Policy and any applicable laws and regulations. Patients consent to the release of their information to authorized healthcare providers, organizations, or other entities involved in their care, as necessary for the provision of healthcare services and treatment coordination.


Patients understand that while we take measures to protect the privacy and security of their information, we cannot guarantee absolute confidentiality, and there may be circumstances where disclosure of information is required by law or necessary for the safety and well-being of the patient or others.
